SEC. 31.1400 BOARD OF ADJUSTMENT
There shall be a Board of Adjustment consisting of seven (7) members (two (2) will be designated as alternates by Board) appointed by the Mayor and confirmed by the City Council. The members shall hold office and the Board of Adjustment shall be governed and controlled by the provisions of Article
1011-g, revised Statutes of Texas, as amended 1959, 56th Legislature, page 545, Chapter 244, Section 1, Acts 1961, 57th Legislature, page 687, Chapter 322. Section 1.

31.1401 BOARD OF ADJUSTMENT POWERS

31.1401.1 HEAR AND DECIDE APPEALS
To hear and decide appeals where it is alleged there is an error in any order, requirement, decision or determination made by an administrative official in the enforcement of this code.

31.1401.2 HEAR AND DECIDE ZONING EXCEPTIONS
To hear and decide special exceptions to the terms of this chapter upon which the Board is required to pass herein.

31.1401.3 GRANT ZONING VARIANCES
To authorize, upon appeals and specific cases, variances from the terms of this Chapter as will not be contrary to the public interest. This authority is to be used in instances where, owing to special conditions, a literal enforcement of the provision of this ordinance will result in unnecessary hardship, and in such a manner that the spirit of this Chapter shall be observed and substantial justice done. The special conditions must be unique to the applicant's property and beyond the applicant's control. Any variance will be deemed contrary to the public interest if it adversely affects other property owners in the
vicinity of the subject property. (Amended 12/13/00, Ord. No. 00-18)


Note: Pursuant to the Texas Local Government Code, at least four members of the Board of Adjustment must vote in favor of the grant of a variance in order for a variance to be granted. The Board of Adjustment may only act at a properly noticed meeting.
